Boat Owner Terms

These terms are for people who use Marine Inspect as a boat owner. They cover the free boat owner account, on the website at marine-inspect.co.uk and in the Marine Inspect app. Please read them before you create an account. Our Privacy Policy explains how we use your information.

If you use Marine Inspect for your work as a marine surveyor, or for a Certifying Authority, our Terms & Conditions apply to you instead.

1. Who we are

Marine Inspect is a trading name of Near Max Ltd, a company registered in England and Wales (company number 09222812). "We", "us" and "our" mean Near Max Ltd. You can reach us at support@marine-inspect.co.uk.

2. The boat owner service

2.1 A boat owner account lets you search our directory of independent marine surveyors, save surveyors to a shortlist, keep private notes, see a surveyor's contact details and tell us privately about your experience.

2.2 The boat owner service is free. We do not charge boat owners for it. If that ever changes, we will tell you first, and nothing will be charged unless you agree to it.

2.3 These terms alone govern boat owner accounts. They are separate from the Terms & Conditions for surveyor and Certifying Authority accounts.

2.4 We may improve or change the service. If a change affects you significantly, we will tell you in advance where we reasonably can.

3. Your account

3.1 You must be 18 or over to create an account.

3.2 An account is for one person. Please keep your sign-in details to yourself, and tell us straight away if you think someone else has used your account.

3.3 Please give us accurate details and keep your email address up to date.

3.4 The account is for arranging surveys of boats you own, look after, or are thinking of buying.

4. The surveyors are independent

4.1 The surveyors in the directory are independent professionals. They do not work for us, and we do not act for them or for you.

4.2 We list surveyors as a public resource. We do not assess or endorse their qualifications, insurance or work. Please check these for yourself before you instruct a surveyor.

4.3 When you instruct a surveyor, your agreement is with that surveyor. We are not a party to it. The survey, the report and the fee are matters between you and the surveyor.

4.4 A listing says nothing about whether a surveyor uses Marine Inspect for their own work.

5. Contact details and fair use

5.1 You can see a surveyor's contact details so that you can arrange a survey or ask about one. Please use them for that purpose only.

5.2 You agree not to:

  • copy or collect listings or contact details in bulk, by hand or by automated means;
  • use contact details for marketing or selling, or pass them to anyone else to use;
  • work around the daily allowance or any other protection in the service;
  • use the service unlawfully or in a way that harms anyone.

5.3 While you are signed in, you can see contact details for up to 20 different surveyors a day without a person check. After that, we ask for the same quick check as any visitor. This protects the surveyors listed.

6. Your shortlist and notes

6.1 Your shortlist and notes are private to you. We do not show them to surveyors or anyone else, and we use them only to provide the service to you.

6.2 Please keep notes fair and factual, and leave out other people's sensitive personal information.

6.3 Your shortlist holds up to 10 surveyors. If a surveyor leaves the directory, we tell you on your shortlist and remove their name and contact details. Your note and dates stay with you until you delete them.

7. Telling us about a surveyor

7.1 You can tell us privately about your experience with a surveyor. We never publish what you tell us.

7.2 Please be honest and accurate. We may use what you tell us when we contact the surveyor, and we keep your name and email address to ourselves unless you agree otherwise.

7.3 A report never changes a listing on its own. We decide what to do, if anything, under our directory policy.

8. Emails from us

8.1 We send you emails about your account, such as a welcome when you join and a confirmation if you delete it.

8.2 We send marketing emails only to boat owners who have chosen to receive them.

9. Ending your account

9.1 You can delete your account at any time, from your account page on the website or in the app. We then clear your records. Our Privacy Policy explains anything we keep, and for how long.

9.2 We may suspend or close an account that breaks these terms seriously or repeatedly, or where the law requires it. Where we reasonably can, we will tell you why first and give you a chance to respond. While an account is suspended, you can still read your shortlist, download your data and delete your account.

9.3 If we ever stop offering the boat owner service, we will give you at least 30 days' notice by email, so that you can export your notes.

10. Our responsibility to you

10.1 We provide the service with reasonable care and skill.

10.2 Directory listings come from surveyors themselves and from public sources. We work to keep them accurate, and a detail may still be out of date. Please confirm anything important with the surveyor. We may correct, pause or remove any listing at any time, for example when its details look wrong.

10.3 We are responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. Loss is foreseeable if it is obvious it would happen, or if we both knew it might when you accepted these terms. The service is for personal use, so we are not responsible for business losses.

10.4 Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. Nothing in these terms affects your legal rights as a consumer.

11. Changes to these terms

11.1 We may update these terms. If a change matters to you, we will tell you before it takes effect and ask you to accept the new version the next time you sign in. If you would rather not, you can delete your account.

12. The law that applies

12.1 These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.

12.2 If something goes wrong, please contact us first at support@marine-inspect.co.uk. We will do our best to put it right.
